GENERAL TERMS & CONDITIONS

1. Scope

These General Terms and Conditions (GTC) govern all business relationships between Rush Cars AG (hereinafter "Seller") and its customers (hereinafter "Buyer"). Deviating conditions of the Buyer are only recognized if the Seller has expressly agreed to them in writing.

  • Conclusion of a purchase, sale, or brokerage agreement
  • Use of consulting and service offerings

2. Conclusion of Contract

A contract is concluded when the Buyer accepts an offer from the Seller in writing or verbally and the Seller confirms acceptance. The display of cars on the website does not constitute a binding offer but rather a non-binding invitation to submit an offer. The Seller reserves the right to reject offers without giving reasons.

3. Prices and Payment Terms

All prices are quoted in Swiss Francs (CHF) including statutory VAT, unless otherwise stated. Payment of the purchase price is due upon handover of the car, unless a different arrangement has been agreed.

  • Cash payment upon handover
  • Bank transfer before handover (car will be released upon receipt of payment)
  • Financing through a financing partner arranged by Rush Cars AG

4. Car Descriptions and Condition

Car descriptions are made to the best of our knowledge. The details recorded in the individual purchase contract are authoritative. Used cars are sold in their current condition. Deviations from the website description may occur due to display differences (e.g., screen colors) and do not constitute a defect.

5. Delivery and Handover

Handover of the car takes place at the business premises of Rush Cars AG in Emmenbrucke, unless otherwise agreed. For shipping or delivery to another location, costs and risk transfer to the Buyer upon handover to the carrier. The Seller endeavors to meet agreed delivery dates but assumes no liability for delays beyond its control.

6. Retention of Title

The car remains the property of Rush Cars AG until the purchase price has been paid in full. The Seller is entitled to register the retention of title. The Buyer undertakes to treat the car with care until full payment and not to sell it to third parties.

7. Warranty and Liability

The manufacturer's warranty applies to new cars. For used cars, warranty is governed by the Swiss Code of Obligations (Art. 197 ff. CO). Liability for slight negligence is excluded to the extent permitted by law. The Seller is not liable for indirect damages, lost profits, or consequential damages. The Buyer must report any identified defects in writing immediately after handover.

8. Deposit and Cancellation

When reserving a car, a deposit of at least 10% of the purchase price is required. The deposit is credited towards the purchase price upon completion of the sale.

  • The deposit secures the car exclusively for the Buyer and removes it from active sales.
  • If the Buyer withdraws without valid reason, the deposit may be retained as compensation.
  • If the Seller withdraws, the deposit will be refunded in full.

9. Trade-In

For trade-ins, the value of the exchanged car is determined by Rush Cars AG based on an assessment. The assessment is non-binding until both parties have confirmed the trade-in value in writing. The traded-in car must be free from third-party rights.

10. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which can be viewed on our website at /impressum. The Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR) apply.

11. Applicable Law and Jurisdiction

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from or in connection with these GTC is Emmenbrucke, Canton of Lucerne, Switzerland. Mandatory statutory places of jurisdiction remain reserved.

12. Severability Clause

Should any provision of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that most closely approximates the economic purpose of the invalid provision.

13. Amendments to the GTC

Rush Cars AG reserves the right to amend these GTC at any time. The current version is available on our website. For existing contracts, the GTC valid at the time of conclusion of the contract shall apply.
